Just So You Know

It goes without saying that the CoViD pandemic and the resulting closure of the nightlife in Thailand has persuaded many bar girls online to earn money that may not have gone online if circumstances were different. As making adult content in Thailand is illegal, this can be a difficult decision for many Thais. In this blog we will discuss how the criminalization of sex work is hurting and making sex work more dangerous for sex workers.

No Brainer
Let’s discuss the recent interest in Thailand finally coming out of the darkness and admitting what we all knew to be true since Adam was a boy. For people that have not yet experienced the contrast between Thailand’s traditional and Thailand’s realistic attitude between conservative family values and liberated sexual expression. It can look to outsiders like a clueless catholic father whom thinks he has raised the perfect innocent Christian girl, when in reality his darling daughter has been ridden more often than the local bus.

For many it’s a no brainer, the nightlife is a huge attraction to Thailand and to suggest that prostitution does not occur in a country where prostitution is still prohibited, is equivalent to prohibition era establishments looking befuddled after being raided and stating “I’m sorry officer, I have no idea how these Whiskey Bottles got into our cellar”. But never the less, we all pretend that there is no prostitutes, and that the half naked ladies standing outside bars are waitresses that are as pure as the fallen snow.

Reality Check
Back in reality, a recent case of a Thai lady with an Onlyfans account where she sells private access to videos, photos and live streams for her paying customers, has found herself in hot water for publication of pornography in a country where the publication or even the participation in pornography is prohibited. But this time, things are different. Alas perhaps this could be the one and only good thing to come out of the covid 19 pandemic. A young lady that was told she could not work, and had very few options, chose to start an Onlyfans account to support her family and is now being punished for doing so.

Sex Work is Work
The outrage that has come from this, has caused many Thai people to ask questions like “If the state doesn’t help this lady to support her family, then who are they to tell her what she can or can’t do to support her family by herself?” It is an interesting question as to where the states responsibility begins and ends. If you can’t help this lady, then why hinder her ability to help herself? Surely that is a very clear case of wanting to have your cake and eat it too? Protests have started and a new interest in the government looking at its outdated and draconian laws pertaining to pornography and sex work have commenced, but how do you develop this conversation when the starting point is murky at best.

We are starting from a position that is already factually erroneous, if the current position is that all sex work is illegal and therefore already heavily policed then that starting position is not based in reality. The defence proving that their client was participating in acts that have been practised for some time already should be relatively simple to prove. But does the addition of the camera make it different? All parties are consenting adults and should the state be in the business of telling people how they need to behave in their own home?

What the Doctor Ordered
Lets discuss what a repeal of the current laws could mean for the future of nightlife in Thailand. So let us make believe that we now live in a Thailand were prostitution has been decriminalised and sex work is openly practised. All sex workers are licensed therapists whom pay taxes and undergo monthly health checks. Only sex workers that are licensed can practise their trade and there will be harsh consequences for any establishments whom hire unlicensed sex workers, which will go a long way toward stamping out human trafficking. The insurances and taxes will insure a fair payment system for all sex workers and legitimacy will now govern an illegitimate practise. Pimps will now be Procurement Managers, Prostitutes will now become therapists, Johns will now become patients and brothels will now become clinics, It’s a win / win for everyone.

We could be on the cusp of a new dawn, between the recent decriminalisation of marijuana and now possibly the decriminalisation of sex work, what will that look like for Thailand? Germany and the Netherlands have already decriminalised sex work and the reality is, that Pattaya, Phuket and Nana Plaza, Patpong and Soi Cowboy already look very similar to Amsterdam and Berlin. If anything Pattaya is a more extreme version of Amsterdam, and a lot less depressing. There is a big difference between approaching a half naked lady working in a bar with no windows or doors in Pattaya vs approaching a lady wearing a parka jacket while shivering next to a radiator under the neon glow of her window in Amsterdam during the depth of a European winter.

The whole experience in Thailand is a much more exotic and exciting experience. In Thailand, you can flirt, you can be teased and for the price of a few drinks you can have a full nights companionship and then go home with the charming lady that spent the night talking with you, sitting next to you, held your hand, allowed you to place your hand on her thigh. A word of warning, DON’T EVEN TRY any of that in Amsterdam or Berlin. If you waste even 5 minutes of a lady’s time, you are looking at either a beat down from her pimp or payment of an hour of her time as compensation for being a moron.

Pattaya's Crazy Nightlife
There are a lot of advantages that Thailand has over other red light districts in Europe, warm and exotic weather for a starter, the low cost of living, quality and affordable hotels and the uncompromised and friendly attitude that Thai ladies still have toward foreign visitors. If Thailand loses its stigma toward sex work, it could be a big game changer with international travel, but…. Even if its not, wouldn’t it be better if we can all just call it what it is? If you take away the sin, you take away the shame…. And while were at it, wouldn’t it be great if bar girls had a union?

Just So You Know

Wrap Up
Current laws criminalizing sex work puts sex workers in extra danger and reduce the opportunities for sex workers to earn a living. Decrimalization of sex work is happening in some countries around the world but much slower is some. Pressure for groups against legalizing sex work is hurting sex workers.
